VAWA is a very powerful piece of legislation that has been successful in protecting abused spouses and children. Moreover, VAWA has very definite provisions to protect immigrants in abusive relationships. Below are the three main components of VAWA1
Who can use or benefit from VAWA?
Although VAWA stands for “Violence Against Women Act”, it applies to all spouses including abused men and children. A VAWA petition can be filed in situations where the spouse of the US citizen or Permanent Residence has abused the alien. Abuses do not always have to be physical. Abuse can be mental, psychological, physical, or a combination of all the above. In fact, many abuses are psychological and sometimes leave long lasting scars.2 -

Obtaining a Green Card through Investment!
In 1991, Congress created the EB-5 visa program to benefit the U.S. economy and create new jobs by encouraging foreign nationals to invest in the U.S. To qualify for an EB-5 visa, the individual must establish that (1) he or she is coming to the U.S. to invest in a new commercial enterprise, (2) the investment occurred after November 29, 1990 (the date the EB-5 program became effective), and (3) this ongoing enterprise will benefit the U.S. economy.
Once granted an EB-5 visa, the individual, his/her spouse and children (under 21) are automatically granted conditional residency, which becomes permanent after 2 years. After 5 years in EB-5 status, an individual can apply for U.S. residency. There are 10,000 EB-5 visas available each year – 3,000 of which the USCIS sets aside for individuals who invest in approved ”targeted employment” areas. ”Targeted employment” typically refers to rural areas or areas that suffer from extremely low employment rates; each State’s Department of Commerce publishes a list of approved ”targeted areas.” Note that the targeted employment plan is set to expire on September 30, 2008.

No more concurrent filing under Form I-360 for Religious workers

On August 20, 2010, a three judge panel of the Ninth Circuit reversed and remanded for further proceedings, the district court’s decision (2009 WL 799683) allowing religious workers to file their adjustment of status applications concurrently with the organizations’ I-360 petition. RuizGarcia v United Sates2, No. 09-35734 (9th Cir. Aug. 20, 2010). Religious workers will not be able to file concurrently their I-360 and I-485 (adjustment of status) applications.The law is not in effect yet, so those wishing to file should do it quickly.
