Iowa mom gets life in prison in neighbor's death

FORT DODGE, Iowa (AP) — A woman convicted of killing her northwest Iowa neighbor as part of an elaborate plot to frame her husband maintained her innocence Monday as she was sentenced to life in prison during an emotional hearing.

Tracey Richter, 45, claimed she shot 20-year-old Dustin Wehde in her home in 2001 after he and another man broke in and strangled her with pantyhose. She appeared on national television soon after the shooting, telling how she killed Wehde to protect herself and her three children.

Jurors sided with prosecutors, who said Richter made up the story as part of a convoluted plot to frame her ex-husband. They said Richter shot Wehde to keep him quiet.

She was convicted Nov. 7 of first degree murder, which carries a mandatory sentence of life in prison without parole. Richter said she plans to appeal. Iowa has no death penalty.

Richter told the courtroom that she broke down and cried when she learned she had shot Wehde.

"All I know is what I experienced that night and that I was defending my family from two people and Dustin was one of them," Richter said.

She apologized to Wehde's mother and for the pain his death has caused.

"I would rather spend the rest of my life in jail for a crime I didn't commit and have my three children alive then lose one of my children and be free," said Richter, who lived in Omaha, Neb., before her trial.

But she added: "I didn't murder your son."

Wehde's family also spoke at the hearing.

"You killed his hopes and dreams," said Ashley Pingree, Wehde's 24-year-old sister. "He missed everything, all because of you."

Wehde's other sister, Brianna Wehde, 21, was too overcome to testify. Sandy Aschinger, a victim witness coordinator, read her statement, which recounted the fun times the siblings had shared.

Dustin's mother, Mona Wehde, said has struggled with depression and alcoholism since her son's death.

"Not one day I don't envision my son's body, see his blood," she said. "He did not deserve to be so cruelly taken. I don't deserve to have to live my life with this pain, without my child."

Prosecutors said Richter killed Wehde to keep him quiet about his role in a plot to frame her ex-husband. They said she lured him to her home then had him write in a notebook that her ex-husband hired him to kill her and her son. She then shot him nine times with two guns.

Richter was involved in a custody fight at the time, and prosecutors said she was trying to gain an advantage before an upcoming hearing to keep from losing her son and $1,000-a-month child support payments.

Shot him in 2001? It took 10 years to get her tried and sentenced? No wonder states are going broke. This case alone must have cost mega bucks and thats not counting what it cost to feed and house her.

A person ahs a right to defend their home, and to shoot a intruder but she Shot him 9 times with two different guns??? I doubt a person could claim 'heat of the moment' and 'self defense', heck even if she emptied one gun I could go for that, but not 2 different guns!

It really bothers me how women consider "Child Support" as THEIR MONEY. It's not your money, it's support for the child.

Maybe I missed it in another article, but, she said the one she killed and another guy was there. What happened to him? Where is he?

Now the Husband gets sole custody of all 3 children. Dumb broad, not only did you give your husband a cool Christmas present, but you just had to tie a nice fancy bow on top by going to jail. It's a double whammy. #coolface

All this so she wouldn't loose her child and pay 1,000 a month in child support? Guess what hunney you just lost him

It would be a little hard to convince a jury you were surprisingly assaulted yet just happened to have TWO loaded guns handy and needed to empty BOTH of them into the bad guy in order to protect yourself.

Shot him nine times with two guns...what happened to the other man that was suppose to be with him?? Sounds like a weird scheme gone bad.

Sounds like there is a whole lot of this story missing from this piece !!

Ok I can see both versions of the story as possible, but shot nine times with 2 guns makes self defence of herself and kids unlikely.

I actually know of a woman who has married 5 different men, had 5 different children by them, and collects child support for all of them. Thats how she makes a living because she has never worked. When her first child, a boy turned 18, she kicked him out of her house. Now he lives with his dad and is quite happy. But what I dont get is why these men keep marrying her with her bad track record. She is not attractive at all, so thats not the reason.....

She lured him into her house, held him at gunpoint and forced him to write that he was a hitman. How many hit-men you heard of that go around armed with panty-hoes? He was shot three times when he was on the ground and the psycho-hag used two different guns. For those of you who keep saying that she was justified, look at the facts.
